How many months does the process take?
A: The applicant should plan on
applying a minimum of 90 days before the actual start date of the
position.
Q: Does Applicant need
to maintain a residence in his/her home country?
A: Yes. Applicant must be able
to specify an address where he/she will return upon completion of
the program.
Q: Does Applicant need
to obtain a Social Security Card ?
A: Yes. If the applicant has
previously received work permission and has a social security
number, even a non-work social security number, we must have this
information.
Q: Can Applicant apply at any
consulate?
A: Applicant will have to apply
where the nonimmigrant visa application will be issued. This is
usually at the consulate which has jurisdiction over where the
applicant lives. This information is necessary when the applicant
applies, as the petition will be sent directly to the consulate that
is indicated on his/her application.
Q: Can Applicant participate in the h2b
program if he/she has been on the program before?
A: Yes, however, the
applicant must notify us immediately as to the exact dates of when
he/she was in the U.S., the company (s) he/she worked for and the
length of time.
Q: Do H-2B workers have a 30 day
grace period at the end of their authorized employment?
A: No. Workers should leave
within one week of "Authorization Date".
Q: What happens when an H-2B worker
quits?
A: He/she must return home
immediately.
Q: Can a H2B worker extend his/her
visa ?
A: If you are interested in
extension of your H2B Program, we will need for you to fill out and
send a Specific form 120 days prior to your visa's expiry date. Then
we will review your status and we will confirm if this opportunity
is possible (additional fee apply).
Q: Will I be able to
change my job or company after coming in the U.S. ?
A: No. If you leave your primary
assignment and accept a job with another company while you are in
the US, you will be in breach of your contract and will be reported
as "out of status" to the Immigration and Naturalization Service
(INS).
Q: Will I have to pay
income taxes on my income ?
A: Yes, and the amount depends
on the total amount earned in a calendar year. Generally, both
Federal and State income taxes must be paid. However, participants
will have the chance to complete documentation at the end of their
stay so that they can get part of the taxes reimbursed with the help
of a third party tax refund service.
Q: If I have a long-term visitor's
visa for the USA, is it necessary for me to get a H-2B visa as well
?
A: Yes. The visitor's visa
prohibits working; all participants must obtain a H-2B visa. In
applying for a H-2B visa, you must demonstrate strong ties to your
home country.
Q: Is it guaranteed
that I will get a H-2B visa ?
A: No. U.S. Embassy Consuls have
complete authority to approve or deny issuance of visa for any
reason. We are not responsible for visa denials. However, we will
provide you with Recommendations and Guidelines for filling out the
visa application. We we will also review all visa applications
carefully, especially if problems are anticipated
